This Disclaimer of Liability ("Disclaimer") applies to the use of the mobile application xracing (the "App") provided by SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA, headquartered at Praceta de Leiria, n82, 4 Esq, 2755-282 Alcabideche, Portugal, PT517080079 ("we," "us," "our"). By using the App, you ("User") acknowledge and agree to the terms of this Disclaimer, which is an integral part of our Terms and Conditions of Use.
The App is provided for personal informational and entertainment purposes. The User acknowledges and agrees that the use of the App and any information or functionality contained therein is at their sole risk.
2.1. The User is solely and exclusively responsible for complying with all applicable laws, regulations, and traffic codes while operating any motor vehicle, including but not limited to speed limits, traffic signals, and prohibitions on the use of mobile devices while driving.
2.2. THE APP DOES NOT PROMOTE, ENCOURAGE, OR CONDONE THE VIOLATION OF ANY TRAFFIC LAWS, INCLUDING SPEEDING OR ANY OTHER FORM OF DANGEROUS OR ILLEGAL DRIVING.
2.3. The App is a passive recording tool and should not be construed as an authorization or encouragement to exceed legal speed limits or to drive recklessly or illegally.
2.4. The User undertakes to operate the App safely, in a manner that does not compromise their attention to the road and traffic conditions. It is recommended that any interaction with the App be done with the vehicle properly parked in a safe location, or through legally permitted hands-free systems, if applicable.
3.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
3.2. Specifically, and without limiting the generality of the foregoing, we shall not be liable for any traffic accidents, property or personal damage, fines, penalties, or any other legal or financial consequences arising from the User's driving behavior or use (or misuse) of the App.
4.1. The App uses GPS data and other sensors from your mobile device to provide information such as location, speed, distance, and time. The accuracy of this data can be affected by various factors, including but not limited to GPS signal quality, weather conditions, physical obstructions (tall buildings, tunnels), and your device's hardware and software.
4.2. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
4.3. We do not warrant that the App will function uninterrupted, securely, or be available at any particular time or location; that any errors or defects will be corrected; that the App is free of viruses or other harmful components; or that the results of using the App will meet your expectations.
The App is not intended to replace any vehicle safety devices, professional navigation systems, or the driver's good sense and judgment. Decisions made based on information from the App are your sole responsibility.
By using the App, the User declares that they have read, understood, and accepted the terms of this Disclaimer.
