This policy is an integral part of our Terms and Conditions of Use.

1. Ownership of the App and Content

The App, including but not limited to its source and object code, visual design, user interface, features, graphics, logos, icons, images, audio and video clips, data compilations, underlying software, and all other material and content included in or made available through the App (collectively, the "App Content"), is the exclusive property of SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA or its licensors.

1.2. The App Content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of Portugal and international laws.

1.3. xracing and associated logos are trademarks or service marks of SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA. They may not be copied, imitated, or used, in whole or in part, without our prior written permission.

2. License Granted to User

As set forth in our Terms and Conditions, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the App and App Content strictly for your personal, non-commercial use. This license does not grant you any ownership rights in the App or App Content.

3. Restrictions on Use

Except as expressly permitted by us in writing, you may not:

• Copy, modify, adapt, translate, create derivative works from, distribute, sell, rent, lease, loan, sublicense, transfer, publicly display, publicly perform, or otherwise exploit the App or App Content.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or trade secrets of the App.
• Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices contained in the App or App Content.
• Use any data mining, robots, or similar data gathering or extraction methods in connection with the App.

4. User-Generated Content

4.1. Definition of User-Generated Content
Our Services may allow you to create, upload, post, send, receive, and store content. This content, which includes but is not limited to activity data (such as GPS tracks, routes, speed, and statistics), custom route names, comments, text, photos, and videos you upload, is considered "User-Generated Content" or "UGC".

4.2. Ownership
You retain ownership of any intellectual property rights that you hold in your UGC. In short, what belongs to you stays yours.

4.3. License Grant to SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA
By creating, uploading, posting, or otherwise making your UGC available on or through the Services, you grant to SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, cache, reproduce, modify, create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, and publicly display your UGC.

4.4. Purpose of the License
This license is granted for the limited purpose of operating, developing, providing, promoting, and improving the Services, and to research and develop new ones. This license continues even if you stop using our Services (for example, a route you shared publicly may continue to be visible to other users).

4.5. Your Responsibilities and Warranties
You represent and warrant that:

• You are the owner, creator, and rights holder of all UGC you provide, or you have all necessary rights, licenses, and permissions to grant the license set forth above.
• Your UGC and our use of it as permitted by this license does not and will not violate, misappropriate, or infringe on the rights of any third party, including privacy rights, publicity rights, copyrights, trademarks, and/or other intellectual property rights.

You agree to indemnify SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA for any and all claims, damages, or losses arising from a breach of this warranty.

4.6. Right to Remove Content
We reserve the right, but are not obligated, to review, screen, and remove any UGC at our sole discretion and at any time without notice, especially if we believe it violates these Terms.

5. Reporting Intellectual Property Infringement

We respect the intellectual property rights of others. If you believe that your copyrighted work or other intellectual property has been copied or used in a way that constitutes infringement through our App, please provide us with the following information in writing:

• A description of the copyrighted work or other IP that you claim has been infringed.
• A description of where the material that you claim is infringing is located on the App.
• Your name, address, telephone number, and email address.
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright/IP owner or authorized to act on the owner's behalf.
• A physical or electronic signature of the person authorized to act on behalf of the copyright/IP owner.
