Welcome to xracing App (the "App"), provided by SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA, headquartered at Praceta de Leiria, n82, 4 Esq, 2755-282 Alcabideche, Portugal, PT517080079 ("we", "us", "our").
These Terms and Conditions of Use ("Terms") govern your access to and use of the App and all related services (the "Services"). Please read these Terms carefully.
By accessing, downloading, installing, or using the App, you ("User") agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree with any part of these Terms, you must not use the App.
xracing is a mobile application designed to allow the recording and tracking of journeys made in motor vehicles, providing data such as distance, speed, time, and location. The App is intended for personal informational and entertainment purposes. The App is not a professional navigation device or a safety system.
3.1. To access certain features of the App, you may need to create an account. You agree to provide true, accurate, current, and complete information during the registration process and to update such information to keep it accurate.
3.2. You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your account.
3.3. You must notify us immediately of any unauthorized use of your account or any other breach of security.
4.1. You agree to use the App only for lawful purposes and in accordance with these Terms.
4.2. You are solely responsible for complying with all applicable laws, rules, and regulations while using the App, including, without limitation, all traffic laws, speed limits, and safe driving regulations.

4.4. You acknowledge that operating the App while driving can be a distraction. You agree to operate the App safely, preferably before starting to drive or with the vehicle safely stopped, and using appropriate mounts if permitted by law.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, exclusively for your personal, non-commercial use.
The App, including but not limited to its design, text, graphics, source code, software, and other materials ("App Content"), as well as trademarks, logos, and service names, are the property of SUSPENDSCOPE - SISTEMAS DE INFORMAÇÃO, UNIPESSOAL LDA or its licensors and are protected by intellectual property laws. For more details, please refer to our Intellectual Property Policy.
Our Services may allow you to create, upload, post, send, receive, and store content. This content, which includes but is not limited to activity data (such as GPS tracks, routes, speed, and statistics), custom route names, comments, text, photos, and videos you upload, is considered "User-Generated Content" or "UGC". For more details, please refer to our Intellectual Property Policy.
We reserve the right, at any time and in our sole discretion, to modify, suspend, or discontinue the App or any part of the Services, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
The basic version of xracing App is currently provided to you free of charge. You are responsible for any and all charges and fees from third parties, such as your mobile network operator, including any fees for data usage required to use the App.
We reserve the right, at our sole discretion and at any time, to introduce fees for certain features, premium content, or subscriptions ("Paid Services") in the future. We may also, in the future, decide to charge a fee for the App itself.
Should we decide to implement any fees for new or existing services, we will provide you with reasonable advance notice of such changes and the applicable payment terms. This notice may be provided via the email address associated with your account, through an in-app notification, or by updating these Terms.
Any new pricing will not apply retroactively. Your continued use of any Paid Services after the new fees have taken effect will constitute your agreement to pay the new fees. If you do not agree to the new fees, your sole recourse is to terminate your use of the specific Paid Services or the App entirely before the change becomes effective.
10.1. These Terms will remain in effect as long as you use the App.
10.2. We may suspend or terminate your access to the App, in our sole discretion, at any time and for any reason, including if we believe you have violated these Terms.
10.3. You may terminate these Terms by uninstalling the App and ceasing all use of the Services.
Please refer to our "Disclaimer of Liability" which is an integral part of these Terms. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
These Terms shall be governed by and construed in accordance with the laws of Portugal. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Lisbon.
We reserve the right to modify these Terms at any time. We will post the updated version of the Terms in the App and/or on our website xracing.app. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
